PRIVACY POLICY

VLXM LLC --- Vilixium® Brand --- Version 3.0 --- Effective Date: August 18, 2026

This Privacy Policy (this “Policy”) describes how VLXM LLC collects, uses, discloses, retains, and protects personal information in connection with the websites located at wellnessfromwithin.life (the public Wellness From Within site) and www.vilixium.com, including all subdomains of each (including the members area at members.vilixium.com and the partner and CRM portal at portal.vilixium.com), member accounts, and checkout flows (collectively, the “Services”). Wellness From Within is the Private Membership Association (the “PMA”). VLXM LLC, a Florida limited liability company (“VLXM LLC,” “Company,” “we,” “us,” or “our”), is the company that operates the Vilixium® brand and commercially supports the PMA under licence from its parent company. For cookies, see our Cookie Policy. For consumer health data collected in the members-area wellness assessment, see our Consumer Health Data Privacy Policy, which supplements this Policy. For California residents, see our California Privacy Rights / Do Not Sell or Share Notice. This Policy is incorporated into our Terms of Service.

The Services are offered to users in the United States. We do not sell or ship products internationally through the Services. Individuals outside the United States may browse public content, but membership and purchasing are available only to U.S. residents in served jurisdictions. By using the Services, you acknowledge that your personal information may be processed in the United States and other jurisdictions where our service providers and corporate affiliates operate.

1. Scope and Applicability

This Policy applies to personal information we collect through the Services, in communications with us, in transactions you make with us, when you apply for or hold membership, when you complete the optional members-area wellness assessment, when you submit member stories or testimonials, when you sign up for emails or SMS, when you participate in promotions or surveys, when you apply to or participate in our Affiliate Program, and when you otherwise interact with us. It does not apply to information collected by third parties we do not control, or to information you provide directly to our affiliated entities under their own separate terms.

2. Personal Information We Collect

2.1 Information You Provide Directly

Identification and contact information: full name, email address, shipping address, phone number, and account credentials.

Membership application information: the information you submit to apply for membership (who you are and how to reach you, shipping jurisdiction, and required acknowledgments). The application does not ask for health information.

Order and transaction information: items purchased, order amount, transaction history, billing and shipping addresses, membership-fee payment, and order status.

Payment information: payment card type, last four digits, expiration date, billing zip code, and tokenized payment identifiers (full payment-card numbers are collected and stored by our payment processors, not retained by us).

Members-area wellness assessment responses: if you choose to complete the optional assessment, your answers about how you have generally been feeling. We treat these responses as consumer health data and handle them under the Consumer Health Data Privacy Policy and Section 2.4 below.

Communications and inquiries: messages, support requests, feedback, survey responses, member stories, testimonials, and other content you submit.

Marketing preferences: email opt-ins, SMS opt-ins, channel preferences, and unsubscribe signals.

Affiliate and partner information: name, contact information, payment routing information, tax identification information where legally required, social handles, and content submitted in connection with the Affiliate Program.

2.2 Information Collected Automatically

Device and technical data: IP address, device identifier, browser type and version, operating system, language and time-zone settings, referring and exit URLs, and similar technical information.

Usage data: pages viewed, features used, links clicked, cart and checkout interactions, session duration, and similar engagement information. On members-area pages that display the wellness assessment, we do not deploy third-party advertising or cross-context behavioral-advertising technologies.

Approximate location data derived from your IP address.

Cookies and similar technologies, as described in the Cookie Policy.

2.3 Information from Third Parties

Payment processors, fraud-prevention vendors, and shipping carriers (to confirm transactions, prevent fraud, and complete delivery).

Affiliate networks and referral platforms (for attribution, payouts, and compliance monitoring). Affiliate attribution data does not include your wellness-assessment responses.

Advertising and analytics partners (for campaign measurement and attribution on public surfaces only).

Service providers supporting our marketing, customer support, and analytics functions, and publicly available sources where permitted by law.

2.4 Sensitive Information and Consumer Health Data

The optional members-area wellness assessment collects information about how you have generally been feeling in order to personalize your member experience. We treat these responses as consumer health data and as sensitive personal information under applicable law. We collect them only with your consent, use them only to personalize your member experience and operate the membership, and do NOT: sell or share them; use them for third-party or cross-context behavioral advertising; transmit them to advertising platforms; or provide them to affiliates. Our full commitments regarding consumer health data — including how it is collected, used, retained, and how you can withdraw consent or request deletion — are set out in the Consumer Health Data Privacy Policy. Please do not include diagnoses, medication information, or other sensitive health details you do not wish to disclose in any free-text field or testimonial.

3. Sources of Personal Information

We collect personal information directly from you, automatically through your interaction with the Services, and from third parties, including service providers, payment processors, shipping carriers, advertising and analytics partners (public surfaces only), affiliate platforms, fraud-prevention vendors, and publicly available sources.

4. How We Use Personal Information

Operate the Services; review membership applications; administer membership; and process Orders and Subscriptions.

Personalize your member experience, including using your wellness-assessment responses (with consent) to tailor the member path page for you — and for no other purpose without further consent.

Provide customer support, respond to inquiries, and administer Accounts.

Send transactional communications (application status, order confirmations, shipping notices, subscription notices, legal notices, and security messages).

Send marketing communications where permitted by law and your preferences. We do not use wellness-assessment responses or other consumer health data for marketing, and we keep health-adjacent language out of marketing subject lines and preview text.

Detect, prevent, and investigate fraud, abuse, chargebacks, and policy violations.

Measure and improve the Services and our marketing performance (using non-health data on public surfaces).

Comply with legal, regulatory, tax, accounting, and audit obligations, including DSHEA, FTC, and state-law obligations applicable to dietary supplements and ecommerce.

Defend our legal rights and enforce our Terms of Service and other agreements.

Support business operations, including financial reporting, corporate development, and merger, acquisition, or financing transactions.

We do not use personal information to provide medical advice or diagnose health conditions, and we do not use automated processing of your wellness-assessment responses to make decisions that produce legal or similarly significant effects about you.

5. Cookies and Similar Technologies

We use cookies, pixels, local storage, tracking scripts, and similar technologies to operate and improve the Services, remember preferences, keep members logged in, support the members-only store, measure traffic and performance, attribute sales and affiliate referrals, and detect fraud. We do not deploy third-party advertising or cross-context behavioral-advertising technologies on members-area pages that present the wellness assessment. 6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients, as reasonably necessary for the purposes described in this Policy:

Service providers and processors supporting ecommerce operations, payment processing, fraud prevention, hosting, order fulfillment, U.S. shipping, data storage, analytics, email and SMS delivery, affiliate tracking, customer support, and security. Service providers that support the members-area assessment are contractually restricted from using consumer health data for any purpose other than providing services to us.

Our corporate affiliates, including our parent company and other affiliated entities under common ownership, for legitimate business purposes such as consolidated reporting, compliance, fraud prevention, and shared service functions, subject to appropriate data-protection safeguards.

Business successors and parties to corporate transactions (merger, financing, acquisition, restructuring, sale of assets, or similar).

Professional advisors such as lawyers, accountants, auditors, insurers, and consultants.

Law enforcement, regulators, or courts when required or permitted by law.

Other parties with your direction or consent.

We may also disclose deidentified or aggregated information that does not reasonably identify you. We do not disclose consumer health data except as permitted by the Consumer Health Data Privacy Policy and applicable law.

7. Sale or Sharing of Personal Information

We do not sell personal information for money. Under California law, certain disclosures involving advertising, analytics, and cross-context behavioral advertising on public surfaces may be considered “sharing,” and California residents may opt out of that sharing. We do not sell or share consumer health data or wellness-assessment responses under any circumstances. See our California Privacy Rights / Do Not Sell or Share Notice and Section 9.

8. Your Privacy Rights

8.1 California Residents

If you are a California resident and applicable law applies, you may have the right to know, to delete, to correct, to opt out of the sale or sharing of personal information, to limit the use and disclosure of sensitive personal information, and to non-discrimination for exercising your rights. For full details, see our California Privacy Rights / Do Not Sell or Share Notice.

8.2 Consumer Health Data

For the members-area wellness assessment and any other consumer health data, you may withdraw consent, request access, and request deletion as described in the Consumer Health Data Privacy Policy. Because we do not ship to Washington or Nevada and do not use health data for advertising, and because we obtain consent before collecting assessment responses, our practices are designed to meet the standards of leading consumer-health-data laws.

8.3 Canadian and Other Visitors

If you visit the Services from Canada, you may have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws with respect to information we hold about you, including access, correction, and withdrawal of consent (subject to legal or contractual restrictions). Membership and purchasing are not offered to non-U.S. residents through the Services. To exercise any right, contact us at contact@vilixium.com.

8.4 Verification

To exercise applicable rights, contact us using the information at the end of this Policy. We may need to verify your identity before processing your request, may deny a request where an exception applies or where we cannot verify identity, and may require proof of authorization for an authorized agent.

9. Do Not Sell or Share My Personal Information

If applicable California law grants you the right to opt out of sale or sharing, you may submit an opt-out request using the method made available on the Services (including, where applicable, an opt-out link in the website footer) or by contacting us at contact@vilixium.com. Where required by law, we honor recognized opt-out preference signals (such as the Global Privacy Control). Consumer health data is never sold or shared regardless of any signal. See our California Privacy Rights / Do Not Sell or Share Notice.

10. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. Membership is limited to adults 18 and over. If we learn that we have collected personal information from a child under 13 without required parental consent, we will take reasonable steps to delete it. Contact us at contact@vilixium.com with any concern.

11. SMS, Email, and Marketing Communications

If you opt in to marketing emails or SMS, we may use your contact information and related engagement data to send promotional content, member updates, and similar communications, subject to applicable law (including CAN-SPAM and TCPA). We do not use consumer health data for marketing and keep health-adjacent language out of subject lines and preview text. You may opt out of marketing emails via the unsubscribe link, and of SMS by replying STOP. Opting out of marketing does not stop transactional or service messages. Standard message and data rates may apply to SMS.

12. Testimonials, Member Stories, and Public Submissions

If you submit a member story, testimonial, review, or similar content and authorize its use, we may publish it in accordance with the applicable release, our procedures, and applicable law. Member stories are displayed inside the members area. If your submission includes your name, image, or other identifying details, that information may become visible to other members if published. Please do not submit information you do not want shared. Published testimonials may carry required disclaimers and may be edited for clarity, accuracy, compliance, or length.

13. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, complete transactions, maintain business records, comply with legal obligations, resolve disputes, enforce our agreements, detect and prevent fraud, and defend chargebacks and arbitration claims. Consumer health data is retained only as long as necessary for the purposes for which it was collected and as described in the Consumer Health Data Privacy Policy. When personal information is no longer reasonably necessary, we may delete, deidentify, aggregate, or otherwise dispose of it in accordance with applicable law.

14. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit, vendor diligence, role-based access, and incident response procedures. Consumer health data is subject to access controls limiting it to personnel who need it to operate the membership and is kept segregated from marketing and advertising systems. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

15. Third-Party Services and Links

The Services may include links to or integrations with third-party websites, applications, content, payment processors, shipping providers, analytics vendors, affiliate platforms, or other services we do not control. We are not responsible for their privacy, security, or business practices. Your interactions with them are governed by their own terms and policies.

16. U.S. Processing

The Services are operated from the United States, and personal information may be collected, processed, stored, and maintained in the United States or other jurisdictions where our service providers and corporate affiliates operate. Where personal information is transferred between jurisdictions, we rely on appropriate legal mechanisms and contractual safeguards as required by applicable law.

17. Deidentified and Aggregated Information

We may deidentify, anonymize, or aggregate information so that it can no longer reasonably identify you, and may use and disclose such information for lawful business purposes. Where we treat information as deidentified, we maintain it in deidentified form and do not attempt to reidentify it, except as permitted by law.

18. Automated Decision-Making

We do not engage in automated decision-making that produces legal or similarly significant effects about you without human involvement. Membership applications are reviewed by a person. To the extent we use automated systems for fraud detection, eligibility screening, or analytics, those systems support — and do not replace — human review for decisions that materially affect you. We do not use automated profiling of your wellness-assessment responses.

19. Changes to This Policy

We may update this Policy from time to time. When we do, we will post the updated version and revise the Effective Date. If changes are material, we may provide additional notice as required by law. Your continued use of the Services after the effective date constitutes acknowledgment of the updated Policy.
